Job Description

The incumbent is responsible to provide legal advice to business operating units, namely, PSC, PPR including support function, Operations, Procurement and Finance and RES. To provide International Trade Compliance Officer duties and will be responsible for implementing and overseeing the maintenance of internal export controls.

Main tasks and responsibilities

  1. Support and assist Sales and Project Management (PSC and PPR) in contract negotiations and full vetting of legal terms and conditions from customers across the various business units.
  2. Review Terms and Conditions for new suppliers (defined in the local contract review process). Retain and maintain all records.
  3. Support project related procurement regarding liability and flow down of sales related contract terms, support frame agreement negotiations with major sub suppliers.
  4. Management of warranty claims from the legal side
  5. Provide training to the organization regarding 10 Golden Rules and Trade Compliance issues.
  6. Fulfil the role of the International Trade Officer and ensure strict compliance with the trade control regulations and laws as established by the government of the country in which the company is located as well as with those foreign countries to the extent applicable to the company’s export or import transaction.
  7. Assist the sales organization with the IDDA Process if requested (e.g. provide background checks or other documentation required – originator of IDDA should be the sales manager in charge).
  8. Assist with Debtors letters of demand.
  9. Set up and negotiate [and monitor] framework agreements.
  10. Support management with Lease Agreements from the legal side. Further assignments by local management and/or by BU Counsel Power.

Qualifications/Experience and Knowledge Required:

  • Com Degree or Legal qualification.
  • 3 – 5 years of legal/commercial experience.
  • Sound understanding of risk management and ability to judge business transactions in terms of risks and related remedial measures.

  • Ensure all business units are operating in a legally viable manner.
  • Sound processes are established and in place to ensure that contracts/agreements within the company are compliant with legal requirements and (regarding sales contracts) with our organisation’s 10 Golden Rules.

Proper risk assessments are established as a basis for decisions to be made under the 10 Golden Rules and silver rules Exceptions Directive
